1. קבלה ותחולה

These Terms & Conditions ("Terms") govern your access to and use of Levelux, the website at levelux.nibtip.tech, and related support channels provided by NibTip Labs.

By downloading, installing, accessing, or using Levelux, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Levelux.

These Terms apply to the maximum extent permitted by law and by the app store rules that apply to the copy of Levelux you use. If mandatory consumer-protection law gives you rights that cannot be waived, those rights are not limited by these Terms.

The English version controls these Terms. Localized headings are provided for navigation only; the legal body remains in English.

Levelux is a minimalist single-player flow puzzle for mobile devices. Players move energy between neighboring cells, build balanced zones, reduce pressure, and keep the board from overheating.

The game is designed for short offline-first sessions. Features, store availability, monetization, advertising, and unlock mechanics may vary by platform, device, operating system, app store region, accessibility settings, and product version.

Descriptions, screenshots, videos, store text, website copy, roadmap notes, and promotional materials are informational only. They do not guarantee that every feature, visual state, price, language, platform version, or monetization model will be available at all times or in every region.

3. זכאות

You must be legally capable of accepting these Terms under the laws that apply to you. If you are under the age of legal majority in your jurisdiction, you may use Levelux only with permission from a parent or legal guardian.

If you use Levelux on behalf of an organization, you confirm that you are authorized to bind that organization, and "you" includes that organization where the context allows.

4. רישיון

Subject to these Terms and applicable store rules, we grant you a limited, revocable, non-exclusive, non-transferable license to use Levelux on compatible devices that you own or control.

Levelux is licensed, not sold. No ownership rights in the software, artwork, game design, brand, source code, object code, icons, screenshots, music, sound design, levels, mechanics, documentation, website content, or trademarks are transferred to you.

Except where mandatory law expressly permits it, you may not sublicense, rent, lease, lend, sell, resell, distribute, host, stream, commercially exploit, copy, modify, adapt, translate, create derivative works from, decompile, disassemble, reverse engineer, bypass technical controls in, or extract assets from Levelux.

Apple App Store / iOS and iPadOS

The Apple version may be offered as a free App Store download with a limited number of meaningful runs. After the free run limit, continued play may require a one-time non-consumable unlock through StoreKit.

The App Store shows the exact price, taxes, currency, and availability before purchase. The Apple version is positioned without ads, subscriptions, consumable boosters, loot boxes, gambling, or paid gameplay advantage.

StoreKit entitlement status overrides the local trial counter. Restoring a purchase depends on Apple's systems, your Apple ID, Family Sharing eligibility where available, App Store availability, and applicable platform rules.

Apple handles payment processing, tax, chargebacks, refund eligibility, and refund execution for App Store purchases. We cannot guarantee that Apple will approve a refund request.

Android / Google Play

An Android / Google Play version may be monetized through Google advertising services and, if offered, Google Play Billing. Ads must not be deceptive, must be appropriate for the app experience and age rating, and must follow applicable Google Play policies, Google advertising policies, and user consent requirements.

Unless a store listing for a specific Android version says otherwise, viewing an ad does not create a cash prize, ownership right, transferable credit, or real-world entitlement.

Apple App Store / iOS and iPadOS

If you obtain Levelux through the Apple App Store, Apple's Licensed Application End User License Agreement and Apple Media Services terms may also apply.

1. This agreement is between you and NibTip Labs, not Apple.
2. For Apple-distributed copies, the license is limited to a non-transferable license to use Levelux on Apple-branded products that you own or control, as permitted by Apple Media Services usage rules, including Family Sharing or volume purchasing where applicable.
3. NibTip Labs, not Apple, is responsible for Levelux, its content, support, maintenance, product claims, legal or regulatory claims, consumer-protection and privacy claims, and intellectual-property claims related to Levelux, except where Apple rules or mandatory law provide otherwise.
4. Apple has no obligation to provide maintenance or support for Levelux.
5. To the extent any warranty cannot be disclaimed under applicable law, NibTip Labs is responsible for that warranty. If Levelux fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price for the Apple-distributed copy according to Apple's applicable rules; Apple has no other warranty obligation for Levelux to the maximum extent permitted by law.
6. You represent that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Apple and its subsidiaries are third-party beneficiaries of the Apple-related terms and may enforce them for Apple-distributed copies.
8. You must comply with applicable third-party terms when using Levelux, including App Store and operating system rules.

Android / Google Play

If you obtain Levelux through Google Play, the Google Play Terms of Service, Google Play Developer Program Policies, Google Play Payments policy, Google Play User Data policy, Google Play Ads policy, Google Play Data safety requirements, and Google Play Advertising ID requirements may apply. Google is not responsible for Levelux except where Google Play rules or mandatory law provide otherwise.

If the Android version displays ads, those ads may be served by Google advertising services. Ads must be identifiable as ads, must not repeatedly block normal gameplay, must not trick users into tapping them, must be appropriate for the app's age rating, and must respect applicable consent, privacy, Data safety, and advertising-identifier rules. Where ad reporting or ad controls are provided by the platform or ad network, users may use those controls for inappropriate ads.

Store pages, payment flows, ad content, ad landing pages, platform account systems, external websites, and third-party services are controlled by their respective providers. We are not responsible for third-party terms, policies, content, availability, or data practices except where mandatory law says otherwise.

You agree not to use Levelux or the website to:

• violate applicable law or third-party rights;
• tamper with security, StoreKit, Google Play Billing, trial, entitlement, ad, consent, or integrity checks;
• reverse engineer protected components except where mandatory law expressly permits it;
• copy, scrape, resell, or redistribute Levelux artwork, code, brand assets, or website materials without permission;
• use bots, automation, modified clients, emulators configured to bypass restrictions, exploit tools, unauthorized overlays, memory editors, or network manipulation to alter gameplay, ads, purchases, entitlements, consent, or store behavior;
• remove, hide, or alter proprietary notices, legal notices, ad labels, consent notices, safety warnings, or store-provided notices;
• abuse support channels or submit unlawful, harmful, infringing, defamatory, misleading, security-sensitive, or excessive content.

8. משחק ומידע מקומי

Levelux is a game of skill and timing. Scores, run outcomes, unlock state, ad-consent state where applicable, and local settings may be stored on your device. They may be lost if you delete the app, reset the device, clear local storage, or change store-account configuration.

We do not guarantee restoration of local scores, local settings, local trial counters, local consent choices, or local progress. Store entitlement restoration applies only to eligible purchases handled through Apple, Google, or another applicable store.

You are responsible for maintaining your device, operating system, backups, store account access, and parental-control or family-sharing configuration. We are not responsible for data loss caused by device failure, operating-system changes, app deletion, storage clearing, account changes, backup settings, unauthorized device access, or third-party services.

We may update, rebalance, patch, rename, redesign, or discontinue features to improve gameplay, security, compatibility, accessibility, or legal compliance.

Some updates may be required for compatibility with future iOS/iPadOS, Android, App Store, Google Play, billing, advertising, consent, or security requirements. If you do not install required updates, some features may stop working.

We do not guarantee uninterrupted availability, perpetual support for any operating-system version, permanent availability in every store or country, or that any specific feature, balance setting, language, price, or monetization model will remain unchanged.

10. פרטיות

The Privacy Policy explains how personal data is handled. The Apple App Store version and Android / Google Play version may differ: the Apple version is positioned without third-party advertising SDKs, while an Android version may include Google advertising services.

You must not submit unnecessary personal, confidential, financial, health, identity, or security-sensitive information through support channels. If you choose to send attachments or diagnostic information, you confirm that you have the right to share that material with us for support, security, legal, or operational review.

11. קניין רוחני

Levelux software, gameplay design, visual assets, icons, copy, website content, trademarks, and branding are owned by NibTip Labs or its licensors and are protected by intellectual property laws.

You may not use our brand assets, artwork, screenshots, icons, product name, or confusingly similar marks in a misleading, infringing, or commercial way without prior written permission.

If you send feedback, bug reports, ideas, suggestions, or gameplay comments, you grant NibTip Labs a worldwide, perpetual, irrevocable, royalty-free license to use them to operate, improve, protect, and promote Levelux without obligation to compensate you, while respecting personal data rules described in the Privacy Policy.

12. תמיכה

Support is provided through the channels we publish, such as email. We do not guarantee fixed response times, availability of support in every language, custom troubleshooting, device repair, data recovery, or compatibility work unless required by law.

When contacting support, share only information necessary to describe your issue. We may decline or stop responding to abusive, unlawful, duplicative, security-risky, or bad-faith requests.

To the maximum extent permitted by law, Levelux is provided on an "as is" and "as available" basis. We do not promise uninterrupted availability, error-free operation, compatibility with every device or operating-system version, data preservation, fitness for a particular purpose, merchantability, quiet enjoyment, or non-infringement.

Levelux is an entertainment product. It is not designed for emergency, safety-critical, medical, financial, legal, professional, gambling, wagering, or prize-awarding use. You should not rely on Levelux for any real-world decision where failure, delay, data loss, or unavailability could cause harm.

14. הגבלת אחריות

To the maximum extent permitted by law, NibTip Labs is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of goodwill, loss of data, loss of progress, device issues, store-account issues, ad-network issues, payment-provider issues, or third-party service failures arising from or related to your use of Levelux.

If liability cannot be excluded, our aggregate liability is limited to the greater of the amount you paid for Levelux during the 12 months before the claim or USD 10, unless mandatory law requires otherwise.

If you use Levelux on behalf of an organization, or if your breach of these Terms causes a third-party claim against NibTip Labs, you agree to defend and indemnify NibTip Labs against that claim to the maximum extent permitted by law. This paragraph does not apply where prohibited by consumer-protection law.

15. השעיה וסיום

You may stop using Levelux at any time by uninstalling the app and deleting local data. We may restrict access to support, website resources, future updates, beta access, or other services if you materially breach these Terms, violate law, infringe rights, manipulate store/ad/entitlement systems, create security risk, or abuse our systems.

Termination does not affect rights and obligations that by their nature should survive, including intellectual property, license restrictions, payment obligations, disclaimers, limitation of liability, indemnity, dispute, governing law, and contact provisions.

16. דין חל

These Terms are governed by the laws of the Kyrgyz Republic, except where mandatory consumer-protection rules in your jurisdiction apply and cannot be waived.

Before starting a formal dispute, you agree to contact us at apps@nibtip.tech and give us a reasonable opportunity to resolve the issue informally, unless mandatory law allows you to proceed sooner.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, asset transfer, or change of control.

17. שינויים בתנאים אלה

We may update these Terms from time to time. If changes are material, we will update the effective date and provide additional notice where legally required.
